Terms and Conditions
In entering into a working contract with Ash Tree Design you are accepting the following terms and conditions:-Design Agreement
Clients must agree to the project requirements and costs before any work can be carried out (not including early design concepts/visuals). Any major changes made to the design, navigation or scale of the project by the clients, that are above and beyond the details of this agreement will incur extra costs and the extension of projected time scales.
Payment Terms Agreement
For projects where the final cost is under £600, payment of fees is required in full on completion, unless agreed otherwise by both parties. For web design services, this is the point when the site goes live.
For projects where the final anticipated invoice amount is above £600, a 25% deposit will be required before any work is carried out (not including early design concepts/visuals).
For projects where the final anticipated invoice amount is above £1200, a 25% deposit will be required before any work is carried out (not including early design concepts/visuals). This will be followed by an additional 25% at the half way stage.
Any outstanding final payment must be received within 28 days of completion, or upload to the clients live web server. Ash Tree Design retain the right to remove any site from public hosting if the terms of this agreement are not adhered to.
Asset Delivery Agreement
The client will provide all text, except in circumstances where a special request has been made. It will be provided in either .txt, .doc format or via email. All photographs provided by the client must be at the highest resolution possible, as either a hard copy suitable for scanning, or in electronic tiff, jpeg, eps, psd or ai format.
Permissions and Copyrights
With regards to copy, logos, images, photos, names and trademarks provided by the client, the client has, or will obtain all the necessary permissions to use said items. Any design contract with Ash Tree Design that involves the use of said items shall be regarded as a guarantee by the client that use has been permitted.
Web Design Copyright
Any scripts, images, photos produced by Ash Tree Design remain the copyright of Ash Tree Design, unless specifically agreed, and may only be commercially reproduced, amended or resold with the permission of Ash Tree Design. The website (as a single entity) will become the property of the client on clearance of all fees due. The client does not have the right to separately use any images, photos of scripts produced by Ash Tree Design used within a site.
Access Agreement
Where circumstances require access to the client’s remote server/folder via FTP, Ash Tree Design must be granted read/write permission. The client if required must provide password access details. Access to any installed sites or designs must be granted on demand.
Removal Agreement
Ash Tree Design retain the right to remove any design or site from public hosting if the terms of this agreement are not adhered to. This includes failure to pay fees overdue.
Third Party Alterations Agreement
Any changes, including deletion or modifications made to a clients site or design by a third party after completion are not the responsibility of Ash Tree Design.
Cancellation Agreement
Notification of a design contract cancellation must be made initially in person or by phone, then by email or writing within 10 working days of initial cancellation. The client must pay for any work up to and including the cancellation date within 28 days. If written notification is not received within 10 days of initial cancellation the full invoiced amount must be paid.
Performance Agreement
The client acknowledges and agrees that Ash Tree Design cannot guarantee the absence of performance interruptions, such as telecommunications problems and other circumstance beyond its control.
